By accessing or using our website, purchasing products, or engaging with our services, you agree to be bound by the following Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access the website or use our services.
1. Business Identity & Trademark Disclaimer
On Deck is an independent online retailer specializing in the resale of authentic, factory-sealed trading card game products. On Deck is not affiliated with, sponsored by, endorsed by, or partnered with Nintendo, Creatures, Game Freak, or The Pokémon Company. All trademarks, service marks, product names, logos, and characters relating to Pokémon appearing on this site are the sole property of their respective owners. Our resale of these items is protected under the First Sale Doctrine, and our use of trademarked names is strictly for descriptive, nominative purposes to identify the products being sold.
2. Product Authenticity & Manufacturer Limitations
We guarantee that all products sold on our website are 100% authentic, officially licensed items. All sealed products are sold in their original factory configuration with manufacturer shrink-wrap and seals intact.
Manufacturer Defects: Because items are sold factory-sealed, On Deck is not responsible for any internal manufacturing defects. This includes, but is not limited to, poor printing registration, centering issues, surface scratches, card sorting errors, or missing components inside a sealed box. Issues of this nature must be directed to the product manufacturer.
2.5 Creative Assets & Digital Imagery Disclosure
On Deck utilizes a combination of custom graphic designs, text-based layouts, and digital illustrations—including assets generated or enhanced using artificial intelligence (AI) tools—strictly for promotional, background, decorative, and placeholder purposes. These digital graphics are intended solely as artistic representations to illustrate upcoming product lines, categories, or website aesthetics and do not depict actual, live-inventory physical box photography
3. All Sales Final & Return Policy
Due to the highly volatile nature of the collectible trading card market and the inherent value of factory seals, all sales are final. We do not accept returns, exchanges, or refunds on any products once they have been shipped.
4. Order Cancellations & Market Volatility
We reserve the right to refuse or cancel any order at our sole discretion. Reasons for cancellation include, but are not limited to: suspected fraudulent transaction data, inventory errors, or clear pricing mistakes. Trading card product prices fluctuate dynamically based on market demand; once an order is placed and confirmed, the purchase price is locked and will not be adjusted retroactively based on subsequent market shifts.
5. Shipping & Limitation of Liability
All orders are packaged securely and shipped using third-party carriers (primarily USPS). Title and risk of loss pass to you upon our delivery of the package to the carrier. On Deck is not liable for carrier delays, packages stolen after proof of delivery, or severe weather damage incurred during transit. We will, however, assist you in filing a claim with the carrier if a package is lost or severely damaged.
6. Governing Law
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Mississippi, United States, without regard to its conflict of law principles.
